Dear Mr. Falce: In your letter dated March 12, 1996, you requested a classification ruling. As requested, the sample will be returned to you. The submitted sample, style 1296 is a pair of cotton knit men's boxer shorts. The items features an exposed elasticized waistband with the words "MICKEY & CO." embroidered at intervals, a one button fly front, hemmed leg openings and a small embroidered patch on the leg. The applicable subheading for style 1296, will be 6107.11.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for men's or boys' underpants, briefs, nightshirts, pajamas, bathrobes, dressing gowns and similar articles, knitted or crocheted: underpants and briefs: of cotton, men's. The duty rate will be 7.8 percent ad valorem. Style 1296, falls within textile category designation 352. Based upon international textile trade agreements products of Sri Lanka are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected.
