Dear Ms. Wallace: In your letter dated November 15, 1993, you requested a tariff classification ruling. You have submitted a sample swatch of woven pile upholstery fabric, style no. 8400 Climatex. The sample is dyed grey. The fiber content of the fabric is 60% wool/16% ramie, which is in the face or pile portion; and 24% nylon, which is in the ground fabric portion. In your submitted summary fact sheet, the fabric is described as a velvet weighing 984 grams per meter. Velvets are of woven cut warp pile construction. The upholstery fabric will be imported in continuous lengths in widths of 135 centimeters. The applicable subheading for the upholstery fabric will be 5801.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for woven pile fabrics and chenille fabrics, other than fabrics of heading 5802 or 5806, of wool or fine animal hair. The rate of duty will be 5.4 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
