The back panel is constructed from 65% polyester, 35% cotton, woven fabric. The garment features a V-neckline; oversized armholes; a full frontal opening with a four button closure; two simulated flap pockets at the waist; and an adjustable tie on the back panel at the bottom. Dear Mr. Simon: In your letter dated July 15, 1993, on behalf of Accessory Network, you requested a tariff classification ruling. In your letter you indicate four garments to be classified. However, you submitted only three garments. Upon further conversation, you requested a binding ruling for only two of these garments; style numbers K43112 and K4310077. Style number K43112 is a woman's vest constructed from crochet and woven fabric. The duty rate will be 7.8% ad valorem. Both garments fall within textile Category designation 859. Based upon international textile trade agreements, products of China are subject to quota restraints and visa requirements. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current import Quotas (Restraint an internal issuance of the U.S. customs Service, which is available for inspection at your local Customs Office. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
