Dear Mr. Basgallop: In your letter dated April 29, 1993, you requested a tariff classification ruling. The pipe is composed of polyethylene, and is available in diameters of 2 inches and 6 inches. This pipe is for use in a saline water line. The applicable subheading for the polyethylene pipe will be 3917.21.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for tubes, pipes and hoses, of plastics, rigid, of polymers of ethylene. The rate of duty will be 3.1 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). Sincerely, Jean F.
