Box 2695 San Juan, Puerto Rico 00902-2695 RE: The tariff classification of Benzalkonium Chloride (CAS # 8001-54-5) from England Dear Mr. Flores: In your letter dated March 4, 1993, you requested a tariff classification ruling on behalf of your client, Allergan American Corp. A sample of Benzalkonium Chloride was submitted with your request. This product, a surface active agent, is a mixture of alkyldimethyl-benzylammonium chlorides. It will be used as a preservative (biocide) in the manufacture of Opticrom 4%. The applicable HTS subheading for Benzalkonium Chloride (CAS # 8001-54-5) will be 3402.12.1000 Tariff Schedule of the United States (HTS), which provides for organic surface-active agents, whether or not put up for retail sale: cationic: aromatic or modified aromatic. The duty rate will be 6.6 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
