Dear Mr Sykes: This classification decision under the Harmonized Tariff Schedule of the United States (HTS) is being issued in accordance with the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). DATE OF INQUIRY : October 10, 1991 DESCRIPTION OF MERCHANDISE : Autotig 250-4 welding unit; MU 111 orbital welding heads HTS PROVISION : 8515.39.0000; 8515.90.2000 HTS SUBHEADING : Electric machines and apparatus for arc (including plasma arc) welding of metals; Parts of welding machines and apparatus RATE OF DUTY : 2 percent ad valorem The Autotig welding unit incorporates components made in the U.S. Allowances may be made under subheading 9802.00.80 for articles assembled abroad in whole or in part of fabricated components, the product of the United States, which (a) were exported in condition ready for assembly without further fabrication, (b) have not lost their physical identity as such article by change in form, shape, or otherwise, and have not been advanced in value or improved in condition abroad except by being assembled and except by operations incidental to the assembly process such as cleaning, lubricating and painting. A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
