Maher & Co., Inc. 442 Canal Street New Orleans, LA 70130 RE: The tariff classification of four men's jackets from Taiwan Dear Mr. Wegener: In your letter dated September 18, 1990, on behalf of Roytex, Inc., you requested a classification ruling. Four samples were submitted as follows: Style numbers 271361, 271362 and 271357 are three men's unlined jackets constructed of contrasting colored inserts composed of a woven 100% cotton fabric. Style number 209520 is a man's unlined jacket constructed of contrasting colored inserts composed of a woven 100% nylon fabric. Style numbers 271361 and 271362 are long-sleeved pullover garments with ribbed knit fabric cuffs and waistband and a partial opening at the neck secured by a zipper. Style 271361 has a stand-up collar with a drawcord and a front hand warmer pocket. Style 271362 has an attached hood with a drawcord and a large pouch pocket with a buttoned flap. Both garments have the trade name "Pierre Cardin" embroidered onto the left chest. Style number 209520 is a long-sleeved pullover garment with elasticized sleeve cuffs and waistband. The garment has a front hand warmer pocket and a stand-up collar with a partial opening at the neck secured by five buttons. A small textile label with the trade name "Pierre Cardin" is sewn onto the top of the hand warmer pocket. Style number 271357 is a short-sleeved garment with a full front opening secured by a heavy-duty zipper closure. The garment has two front slash pockets and a ribbed knit fabric collar, waistband and border at the end of the sleeves. The trade name "Pierre Cardin" is embroidered onto the left chest. The samples are being returned to you as you have requested. The applicable subheading for style numbers 271361, 271362 and 271357 will be 6201.92.2050, Harmonized Tariff Schedule of the United States (HTS), which provides for other men's anoraks, windbreakers and similar articles, of cotton. The duty rate will be 10 percent ad valorem. The applicable subheading for style number 209520 will be 6201.93.3510, HTS, which provides for other men's anoraks, windbreakers and similar articles, of man-made fibers. The duty rate will be 29.5 percent ad valorem. Style numbers 271361, 271362 and 271357 fall within textile category designation 334. Style number 209520 falls within textile category designation 634. Based upon international textile trade agreements products of Taiwan are presently subject to quota restraints and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
