Box 24600 Nashville, TN 37202 RE: The tariff classification of a Mystery Color Case from China. Dear Ms. Gasser: In your letter dated July 12, 1990, you requested a tariff classification ruling. The item is a set of writing implements consisting of 1 Mystery eraser, 10 mystery color markers, 5 Jumbo mystery color markers, 6 color crayons, 1 crayon sharpener, 6 printing stamps, 1 mystery color stamp pad, 6 sheets to color, secret message sheets, and a plastic organizer tray. It is packaged in a vinyl carrying case which is fitted to hold the contents. The applicable subheading for the mystery color case will be 9608.20.0000 Harmonized Tariff Schedule of the United States (HTS), which provides for felt tipped and other porous-tipped pens and markers. The rate of duty will be 8 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
