Dear Mr. Fong: In your letter dated December 5, 1995, you requested a tariff classification ruling for a carrying case. You have submitted a sample and photos of a specially shaped and fitted carrying case composed of molded plastic. The case has a foam interior with cutout fitted sections. You have indicated that the intended use for the case will be to contain U.S. made medical equipment (Ten devises and accessories). However, the carrying case will be imported empty. The case measures approximately 10" x 8" x 2" with an integrated molded plastic carry handle. The applicable subheading for the carrying case of molded plastic will be 4202.99.9000., Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, camera cases and similar containers, other, other, other. The rate of duty will be 20 percent ad valorem. The duty rate for 1996 will remain the same. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
