Dear Ms. Wierbicki: In your letter dated November 9, 1995, on behalf of Sarne Corp./Dover Kidz, you requested a classification ruling for evening bags. The samples submitted, identified as style numbers 54606S/DKE-266 and 54606S/DKE-292, are ladies evening bags composed of a textile white and/or pink satin embroidered fabric with braided shoulder straps. The exterior of both items are decorated with clear glass beads throughout the design. Style DKE-266 has a top design of four triangular petal-like pieces which folds over the braided drawstring closure. The bottom exterior features a braided textile tassel. Style DKE-292 is secured by means of a braided drawstring closure underneath a flap with a metal snap fastener. Your samples are being returned as you requested. The applicable subheading for Styles 54606S/DKE-266 and 54606S/DKE-292, the evening bags of textile man-made fabric in part of braid, will be 4202.22.4030, Harmonized Tariff Schedule of the United States (HTS), which provides for Handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, wholly or in part of braid, other, other, of man-made fibers. The duty rate will be 8.3 percent ad valorem. Items classifiable under 4202.22.4030 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected.
