Dear Ms. Bernard: In your letter dated November 2, 1995, you requested a tariff classification ruling. The submitted samples, product #30579, the "Sesame Street Playtime Pals Set", consist of an infant's cotton terry drooler bib with pvc backing, a plastic water filled teether, and a plastic ring rattle. The bib has textile trim and tie back. The plastic ring rattle is made in China. The water filled teether is made in Mexico and the drooler bib is made in the United States. The products will be blister packed in Mexico. The applicable subheading for the rattle will be 9503.90.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys (except models), not having a spring mechanism. The general rate of duty will be free. The 1996 general rate of duty for subheading 9503.90.0030 will also be free. The applicable subheading for the teether will be 3926.90.9890, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of plastics, other, other, other. The general rate of duty will be 5.3% ad valorem. The 1996 general rate of duty for subheading 3926.90.9890 will also be 5.3% ad valorem. The applicable subheading for the bib will be 9801.00.1098, Harmonized Tariff Schedule of the United States (HTS), which provides for the duty free entry of products made in the U.S. which are exported and returned without being advanced value or improved in condition while abroad.
