Dear Mr. Campbell: In your letter dated November 1, 1995, you requested a tariff classification ruling. You have not submitted samples, however, you have provided us with descriptive literature. The two travel alarm clocks are known as the Dalvey Cabin Clock and the Dalvey Voyager Clock. Both clocks are battery operated with quartz analog movements measuring 45 mm in diameter. The applicable subheading for the travel alarm clocks, if the movements have no jewels or only one jewel will be 9103.10.40, Harmonized Tariff Schedule of the United States (HTS), which provides for Clocks with watch movements, excluding clocks of heading 9104: Battery powered: Other: Having no jewels or only one jewel in the movement. The rate of duty will be 34 cents each plus 6.4% on the case plus 4.9% on the battery. If the travel alarms clocks have more than one jewel in the movement, the applicable subheading will be 9103.10.80, HTS, which provides for Clocks with watch movements, excluding clocks of heading 9104: Battery powered: Other: Other. The rate of duty will be 67 cents each plus 6.4% on the case plus 4.9% on the battery. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
