Dear Mr. Corral: In your letter dated September 30, 1995, on behalf of your client World Bazaar, Inc., you requested a tariff classification ruling. The submitted sample is identified as item #80234, Santa Stocking Holder. This product is made of polystone. The santa figure has a long white beard and it is dressed in a red and white suit with a red and white hat, black boots and black gloves. It has a basket of toys attached to the figure. You stated in your correspondence it is your belief that this product would be classified under heading 9505, this is correct. Sample #10163, Brass Statuette Santa Candle holder and the Brass Statuette of a lady holding a brass candle holder in her hand will be answered under ruling #815361. The applicable subheading for item #80234, Santa Stocking Holder will be 9505.10.5020, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof, other, other, other. The rate of duty will be free. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
