NY 810545 June 30, 1995 CLA-2-62:S:N5:358 810545 CATEGORY: 6202.91.2021 Ms. Tina Sharpe Pleasant Company 8400 Fairway Place Middleton, WI 54562-0998 RE: Classification of a girl's jacket from China. Dear Ms. Sharpe: We refer to ruling letter, DD 810069, which was issued to you from the District of San Francisco, on May 9, 1995. In your initial letter to us, dated April 21, 1995, you requested a binding ruling for a boy's 65% wool and 35% rayon, long sleeve woven jacket. A sample was submitted, but no style number was indicated. One of the garment's features was a 6 metal snap, left over right closure. In accordance with Chapter Note 8, this type of closure is regarded as being designed for man or boy. In a subsequent letter dated May 15, 1995, you brought to our attention the fact that although the sample submitted with your original request was designed for a boy, your actual product would be a girl's jacket with right over left snap closures. All other information remains the same. In light of this additional information, the jacket, no style number indicated, should be classified in subheading 6202.91.2021 @ 45.8 cents/kg + 20.5% ad valorem, category 435. Copies of this supplemental ruling are being provided to all ports where entry of this merchandise will be made. A copy of this letter should be given to your broker and all members of your staff who are involved with clearing merchandise through Customs. If you have any questions pertaining to this matter, please contact National Import Specialist Bruce Kirschner at (212) 466-5865. Sincerely, Jean F. Maguire Area Director New York Seaport
