Dear Ms. Mangual: In your letter dated April 21, 1995, you requested a tariff classification ruling. The submitted sample, HLA-2, is an endless necklace measuring approximately 31" in length and made of quartz crystal and garnet chips. The applicable subheading for the semiprecious necklace, if valued not over $40 per piece, will be 7116.20.0500, Harmonized Tariff Schedule of the United States (HTS), which provides for Articles of...semiprecious stones (natural, synthetic or reconstructed): Articles of jewelry. The rate of duty will be 5.9% ad valorem. If the necklace is valued over $40, the applicable subheading will be 7116.20.1500, HTS, which provides for Articles of...semiprecious stones (natural, synthetic or reconstructed): Articles of jewelry: Other. The rate of duty will be 6.5% ad valorem. Your sample is being returned as requested. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
