Box 3165 Harrisburg, PA 17105 RE: The tariff classification of a drinking glass from Taiwan Dear Ms. Aldinger: In your letter dated April 17, 1995 you requested a tariff classification ruling. A sample was submitted with your ruling request. Although your letter states that this product (item 94845) will be used to hold a candle, the article has the form of a small drinking glass. The glass is decorated with pictures associated with Halloween (Jack O'Lantern, ghosts, black cat, etc.). You indicated that the unit value of the glass is twenty nine and a half cents. The applicable subheading for the glass will be 7013.29.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for drinking glasses...other: other: valued not over thirty cents each. The duty rate will be 37 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction. Sincerely, Jean F.
