Dear Mr. Boland: In your letter dated March 10,1995 you requested a tariff classification ruling. The items you requested classification for were a New Varica Deluxe Iron Bed Pickup (Model #CM6203) and a New Varica 2-seat Standard Window Van (Model #CM6508A); both with spark-ignition internal combustion reciprocating piston engines and weighing 1.75 metric tons apiece. The applicable subheading for the New Varica Deluxe Iron Bed Pickup (Model #CM6203) will be 8704.31.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for Motor vehicles for the transport of goods: Other, with spark-ignition internal combustion piston engine: G.V.W. not exceeding 5 metric tons: G.V.W. not exceeding 2.5 metric tons. The duty rate will be 25% ad valorem. Your inquiry does not provide enough information for us to give a classification ruling on the New Varica 2-seat Standard Window Van (Model #CM6508A). Your request for a classification ruling should include a complete description of it's internal configuration and pictures of both the interior and exterior of the vehicle. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
