Dear Ms. Ciccia: In your letter dated February 17, 1995, on behalf of your client, Fetco International, you requested a tariff classification ruling. The sample submitted is a ceramic picture frame, measuring about 7 inches long by 5 1/4 inches wide, which possesses a recording module affixed to its back portion. It is noted that the essential character of this article is imparted by the picture frame. You state that this article should be properly classified under subheading 6912.00.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for other household articles of ceramic. However, since ceramic picture frames are among the enumerated exemplars listed in the Harmonized Commodity Description and Coding System Explanatory Notes as articles of a kind used for ornamenting or decorating the household or office under heading 6913, HTS, consideration of classification under subheading 6912.00.50, HTS, is precluded. The applicable subheading for the ceramic picture frame with recording module will be 6913.90.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for other ornamental ceramic articles. The rate of duty will be 6.8 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction. Sincerely, Jean F.
