Product description
The sample is an orange colored plastic luggage security device, to which you refer as "padlock", printed with a serial number, for identification purposes. It will be imported packaged in a clear cellophane wrap, which also encloses a printed paper instruction card. The "padlock" measures approximately 1" x 1 1/4", and is lightweight but strong. The instruction card indicates that after use, one "unlocks" the piece of luggage to which it is attached by "twisting or cutting it off". The device, and the printed instruction card, which has a U.S. address on it, are made in the U.S.A., and are sent to Canada for packaging.

Dear Mr. Drapeau: In your letter dated November 15, 1996, you requested a tariff classification ruling. Samples were submitted, which will be retained for reference. The sample is an orange colored plastic luggage security device, to which you refer as "padlock", printed with a serial number, for identification purposes. It will be imported packaged in a clear cellophane wrap, which also encloses a printed paper instruction card. The "padlock" measures approximately 1" x 1 1/4", and is lightweight but strong. The instruction card indicates that after use, one "unlocks" the piece of luggage to which it is attached by "twisting or cutting it off". The device, and the printed instruction card, which has a U.S. address on it, are made in the U.S.A., and are sent to Canada for packaging. The applicable subheading for the "luggage padlock" as described, and imported under these circumstances, will be 9801.00.1098, Harmonized Tariff Schedule of the United States (HTS), which provides for: Other (than certain enumerated) products of the United States when returned after having been exported, without having been advanced in value or improved in condition by any process of manufacture or other means while abroad. The rate of duty is Free. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
