Dear Ms. Bonace: In your letter dated October 20, 1994, you requested a tariff classification ruling. The furniture item is a Swivel Desk Chair, Blair Product #508401. The frame is constructed of chrome plated steel. It has a welted four leg base with dual wheel casters. This desk chair has a padded and upholstered, 100 percent polyester fabric, back and seat. It will be imported and sold unassembled and is designed to be placed on the floor or ground. The applicable subheading for the Swivel Desk Chair will be 9401.71.0030, Harmonized Tariff Schedule of the United States Anmnotated, HTSUSA, which provides for: Seats (other than those of heading 9402), whether or not convertible into beds, and parts thereof: Other seats, with metal frames: Upholstered, other. The duty rate will be 4 percenmt ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry docucuments filed at the time this merchandise is imported.
