NY 801823 September 20, 1994 CLA-2-96:S:N:N3:113 801823 CATEGORY: Classification TARIFF NO.: 9608.20.0000 Ms. Lorraine Apelbaum Nancy Hall, Inc. 435 East 14th Street New York, NY 10009 RE: The tariff classification of marker pens from Hong Kong Dear Ms. Apelbaum: In your letter dated September 1, 1994, you requested a tariff classification ruling. The merchandise consists of five, small, color marker pens packaged in a plastic pouch. We note that the sample you submitted is not marked, as required by law, with the country of origin. Your inquiry does not provide enough information for us to give marking advice on the markers. We recommend that you contact your local Customs district office for assistance in determining an acceptable method of marking before you import the merchandise. The applicable subheading for the markers will be 9608.20.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for felt tipped and other porous-tipped pens and markers. The rate of duty will be 8 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
