HQ 087790 November 21, 1990 CLA-2 CO:R:C:G 087790 JS CATEGORY: Classification Octavian Kovach-North Northimpex Co. P.O. Box 39023 Downey, CA 90241 RE: Women's Fleece Jackets Dear Mr. Kovach-North: This is in response to your letter of August 16, 1990, requesting classification of women's fleece jackets under the Harmonized Tariff Schedule of the United States Annotated (HTSUSA). Customs' regulations require that sufficient information, including a sample of the merchandise at issue, accompany all requests for binding rulings. Based on the information in your letter and the attached illustration, it appears that the garment would be classifiable within heading 6202, HTSUSA. However, due to the variance in construction of the fabric used for such jackets, we cannot issue you a binding ruling without a sample. You may resubmit your request with the required sample. Under the District Rulings Program, you are entitled to a decision within 30 days, unless referral to this office is deemed necessary, in which case a decision will be issued within 120 days of the receipt of your letter. Sincerely, John Durant, Director Commercial Rulings Division
