HQ 086119 December 20, 1989 CLA-2 CO:R:C:G 086119 CMR CATEGORY: Classification TARIFF NO.: Isake Komailevuka Economic and Commercial Specialist U.S. Embassy, Fiji RE: Request for information on behalf of JNJ Corporation Dear Mr. Komailevuka: We do not have sufficient information to issue a ruling on the classification of the garments in question. The information required includes: What type of fabric will the garments be made of -- woven or knit? What is the other fabric fiber? Will the tops and pants be made of identical fabric and how will they be sold in the United States -- separately or as sets? We need a better description of the garments -- for instance, is the basic blouse a pullover or does it have any opening at the neck? Generally, samples are required. What manufacturing processes will occur in Fiji? We can provide some general information. Textiles are excluded from GSP. Therefore, the garments are subject to a rate of duty which is dependent on the fabrics used and the classification of the garments. If the garments are of chief weight polyester, the rate of duty will range from 17 percent to 34.6 percent depending on the garments' classification. Women's blouses and trousers which are wholly the growth, product or manufacture of Fiji are presently not subject to visa/quota requirements. -2- If a binding classification ruling is desired, we suggest that JNJ Corporation make such request in writing, not by FAX, to the following address: Area Director of Customs New York Seaport 6 World Trade Center New York, New York 10048 We are faxing a copy of this letter to the JNJ Corporation. Thank you for your cooperation in this matter. Sincerely, John Durant, Director Commercial Rulings Division 6cc: Area Director, New York Seaport 1cc: CITA 1cc: Legal Reference Section 1cc: Phil Robins
