Vickers Orbichem, Inc. 2001 West Main Street, Suite 140 Stamford, CT 06902 RE: Reclassification of diphenhydramine hydrochloride Dear Mr. Vickers: In your letter of December 16, 1989, you requested classification of diphenhydramine hydrochloride under the Harmonized Tariff Schedule of the United States Annotated (HTSUSA). On January 20, 1989, in NYRL 835299, diphenhydramine hydrochloride was ruled to be classified in subheading 2922.19.1000 HTSUSA, under the provision for diphenhydramine as a base drug. Upon further review, it has been determined that diphenhydramine hydrochloride is a salt form of diphenhydramine and should be classified in subheading 2922.19.1500 HTSUSA. The rate of duty is 7.6 percent ad valorem. Ruling 835299 is hereby amended accordingly. Sincerely, John Durant, Director
