Tariff Engineering

The legal practice of designing, manufacturing, or packaging products to qualify for a lower duty rate.

Tariff Engineering is the legal practice of designing, manufacturing, sourcing, or packaging a product so that it qualifies for a lower-duty tariff classification. Properly executed, tariff engineering is a longstanding and Supreme Court-endorsed compliance strategy.

The seminal case is United States v. Citroen (1903), where the Supreme Court held that "the rule is well settled that 'the commercial designation' is the standard … the importer is entitled to have his goods classified at the rate fixed by law upon the merchandise that he actually imports."

Examples of tariff engineering:

  • Ford imported Transit Connect vans with rear seats and windows (classified as passenger vehicles at 2.5%), then removed them stateside to use as cargo vans (classified at 25% as cargo)
  • Marvel/Toy Biz argued X-Men figures were "non-human creatures" (toys, 6.8%) rather than "dolls" (12%) because mutants are not human
  • Sneaker manufacturers add felt or fabric to outer soles to qualify for footwear headings with lower duty rates

Tariff engineering must be implemented before importation — post-importation manipulation to lower duties is not allowed and can trigger fraud claims under 19 U.S.C. § 1592.
